  1. Niniejsza Polityka Prywatności określa zasady przetwarzania danych osobowych użytkowników serwisu internetowego oraz aplikacji Kick&Fit dostępnej pod adresem www.kickandfit.pl.

2. Zakres przetwarzanych danych osobowych

Administrator może przetwarzać następujące dane osobowe:

  • imię i nazwisko,

  • adres zamieszkania (jeśli wymagany do rozliczeń),

  • dane logowania do konta użytkownika,

  • dane dotyczące płatności (bez danych kart płatniczych),

  • adres IP, dane techniczne urządzenia, dane statystyczne.

3. Cele i podstawy prawne przetwarzania danych (art. 6 RODO)

Dane osobowe są przetwarzane w następujących celach:

  1. Zawarcie i realizacja umowy – art. 6 ust. 1 lit. b RODO
    (utworzenie konta, dostęp do aplikacji, realizacja subskrypcji).

  2. Obsługa płatności i rozliczeń – art. 6 ust. 1 lit. c RODO
    (obowiązki księgowe i podatkowe).

  3. Obsługa reklamacji i kontakt z użytkownikiem – art. 6 ust. 1 lit. b i f RODO.

  4. Marketing własnych usług (newsletter, e-mail, SMS) – art. 6 ust. 1 lit. a RODO
    (wyłącznie na podstawie dobrowolnej zgody).

  5. Analityka i statystyka (Google Analytics) – art. 6 ust. 1 lit. a i f RODO.

  6. Zapewnienie bezpieczeństwa i zapobieganie nadużyciom – art. 6 ust. 1 lit. f RODO.

4. Odbiorcy danych osobowych

Dane osobowe mogą być przekazywane następującym podmiotom:

  • Passion.io – dostawca technologii aplikacji,

  • Przelewy24 – operator płatności,

  • Stripe – obsługa subskrypcji,

  • Google LLC – analityka (Google Analytics),

  • Meta Platforms (Facebook) – wtyczki społecznościowe,

  • biura księgowe, dostawcy IT – wyłącznie w zakresie niezbędnym.

Dane nie są sprzedawane ani udostępniane osobom trzecim w celach marketingowych.

5. Przekazywanie danych poza UE

Dane mogą być przekazywane poza UE (np. Google, Meta, Stripe) wyłącznie na podstawie:

  • standardowych klauzul umownych,

  • decyzji stwierdzających odpowiedni stopień ochrony.

6. Okres przechowywania danych

Dane osobowe są przechowywane:

  • przez czas trwania umowy oraz po jej zakończeniu:

    • dane księgowe – zgodnie z przepisami (do 5 lat),

    • dane konta – do momentu jego usunięcia,

    • dane marketingowe – do cofnięcia zgody,

    • dane analityczne – zgodnie z polityką Google.

7. Prawa użytkownika

Każdemu użytkownikowi przysługuje prawo do:

  • dostępu do danych,

  • ich sprostowania,

  • usunięcia („prawo do bycia zapomnianym”),

  • ograniczenia przetwarzania,

  • przenoszenia danych,

  • wniesienia sprzeciwu,

  • cofnięcia zgody w dowolnym momencie.

Personal data are not sold or shared with third parties for marketing purposes.

5. Transfer of Data Outside the EU

Personal data may be transferred outside the European Union (e.g. Google, Meta, Stripe) only on the basis of:

    • account data – until the account is deleted,

  • rectify their data,

  • erase their data (“right to be forgotten”),

  • restrict processing,

  • data portability,
