Niniejszy Regulamin określa zasady korzystania z serwisu internetowego oraz aplikacji Kick&Fit, dostępnych pod adresem www.kickandfit.pl, a także warunki zawierania i realizacji umów o dostarczanie treści cyfrowych.

Regulamin jest dostępny nieodpłatnie na stronie internetowej Sprzedawcy i może być w każdym czasie zapisany lub wydrukowany przez Użytkownika.

Regulamin stanowi integralną część umowy zawieranej pomiędzy Sprzedawcą a Klientem.

Sprzedawca – AZ REKLAMA Arkadiusz Zadłużny.

Serwis / Aplikacja Kick&Fit – platforma online oferująca dostęp do treści treningowych, rozwojowych i sportowych w formie cyfrowej.

Klient / Użytkownik – osoba fizyczna, która zawiera umowę ze Sprzedawcą.

Konsument – osoba fizyczna dokonująca zakupu w celu niezwiązanym bezpośrednio z działalnością gospodarczą.

Treści cyfrowe – materiały dostępne wyłącznie w formie elektronicznej (aplikacja, materiały online, transmisje live, VOD).

Subskrypcja – odpłatny, czasowy dostęp do treści Kick&Fit (miesięczny, kwartalny, półroczny lub roczny).

Sprzedawca oferuje dostęp do aplikacji Kick&Fit oraz treści cyfrowych, w tym:

• treningów online,

• materiałów treningowych i rozwojowych,

• transmisji live (m.in. treningi na YouTube),

• funkcjonalności aplikacji.

Dostęp do treści jest przyznawany natychmiast po zaksięgowaniu płatności.

Korzystanie z usług wymaga założenia konta użytkownika w aplikacji lub w serwisie internetowym.

Pakiet VIP jest ofertą indywidualną i dostępny wyłącznie po wcześniejszym zakwalifikowaniu Klienta po rozmowie ze Sprzedawcą.

Umowa zostaje zawarta w momencie skutecznego dokonania płatności przez Klienta oraz zaakceptowania Regulaminu.

Akceptacja Regulaminu następuje poprzez zaznaczenie odpowiedniego checkboxa w procesie zakupu.

Klient zobowiązany jest do podania prawdziwych i aktualnych danych.

Płatności realizowane są w walucie PLN.

Dostępne metody płatności:

• Przelewy24 (w tym wszystkie szybkie płatności dostępne w systemie),

• subskrypcje realizowane za pośrednictwem Stripe.

Sprzedawca nie ponosi odpowiedzialności za przerwy lub błędy wynikające z działania operatorów płatności.

Klientowi przysługuje ustawowe prawo odstąpienia od umowy w terminie 14 dni od jej zawarcia.

Niezależnie od powyższego, Sprzedawca udziela dobrowolnej 30-dniowej gwarancji satysfakcji.

W ramach gwarancji satysfakcji Klient może zrezygnować z usługi w ciągu 30 dni od zakupu i otrzymać zwrot środków, pod warunkiem złożenia oświadczenia drogą e-mailową na adres trener@kickandfit.pl.

Zwrot środków następuje w terminie do 14 dni od pozytywnego rozpatrzenia zgłoszenia.

Zwrot realizowany jest przy użyciu takiego samego sposobu płatności, jaki został użyty przy zakupie, chyba że Klient wyrazi zgodę na inny sposób.

Zakupy dostępu do aplikacji Kick&Fit dokonane za pośrednictwem Google Play lub Apple App Store podlegają regulaminom oraz politykom zwrotów obowiązującym w tych sklepach.

Sprzedawca nie obsługuje zwrotów, reklamacji ani anulowania subskrypcji dokonanych poprzez Google Play lub Apple App Store.

Wszelkie roszczenia związane z takimi zakupami Klient powinien kierować bezpośrednio do operatora danego sklepu.

Treści oferowane w Kick&Fit mają charakter informacyjny i treningowy.

Klient korzysta z treści na własną odpowiedzialność, uwzględniając swój stan zdrowia i kondycję fizyczną.

Sprzedawca nie ponosi odpowiedzialności za skutki niewłaściwego korzystania z treści.

W przypadku wątpliwości zdrowotnych Klient powinien skonsultować się z lekarzem przed rozpoczęciem treningów.

Reklamacje dotyczące działania serwisu można składać drogą e-mailową na adres trener@kickandfit.pl.

Reklamacja powinna zawierać opis problemu oraz dane identyfikujące Klienta.

Sprzedawca rozpatruje reklamacje w terminie do 14 dni.

Dane osobowe Klientów przetwarzane są zgodnie z obowiązującymi przepisami prawa oraz Polityką Prywatności.

Administratorem danych osobowych jest AZ REKLAMA Arkadiusz Zadłużny.

Regulamin obowiązuje od dnia publikacji na stronie www.kickandfit.pl.

Sprzedawca zastrzega sobie prawo do zmiany Regulaminu z ważnych przyczyn prawnych lub organizacyjnych.

W sprawach nieuregulowanych Regulaminem zastosowanie mają przepisy prawa polskiego.

These Terms and Conditions are available free of charge on the Seller’s website and may be saved or printed by the User at any time.

The Terms and Conditions constitute an integral part of the agreement concluded between the Seller and the Customer.

Seller – AZ REKLAMA Arkadiusz Zadłużny.

Kick&Fit Service / Application – an online platform providing access to training, fitness and personal development digital content.

Customer / User – a natural person who concludes an agreement with the Seller.

Consumer – a natural person purchasing for purposes not directly related to their business or professional activity.

Digital Content – content supplied exclusively in digital form (application, online materials, live streams, VOD).

Subscription – paid, time-limited access to Kick&Fit content (monthly, quarterly, semi-annual or annual).

The Seller provides access to the Kick&Fit application and digital content, including:

• online training sessions,

• training and development materials,

• live broadcasts (including YouTube live training),

• application functionalities.

Access to the content is granted immediately after the payment is successfully completed.

Use of the services requires creating a user account in the application or on the website.

The VIP Package is an individual offer available only after prior qualification of the Customer following a direct conversation with the Seller.

The agreement is concluded at the moment of successful payment by the Customer and acceptance of these Terms and Conditions.

Acceptance of the Terms and Conditions takes place by selecting the appropriate checkbox during the purchase process.

The Customer is obliged to provide true and up-to-date data.

Payments are made in Polish zloty (PLN).

Available payment methods:

• Przelewy24 (including all fast payment methods available within the system),

• subscriptions processed via Stripe.

The Seller is not responsible for interruptions or errors resulting from the operation of payment service providers.

The Customer has the statutory right to withdraw from the agreement within 14 days from the date of conclusion.

Independently of the above, the Seller grants a voluntary 30-day satisfaction guarantee.

Under the satisfaction guarantee, the Customer may resign from the service within 30 days from the purchase date and receive a refund by submitting a declaration via e-mail to trener@kickandfit.pl.

The refund will be made within 14 days from the positive consideration of the request.

Refunds are made using the same payment method that was used for the purchase, unless the Customer expressly agrees otherwise.

Purchases of access to the Kick&Fit application made via Google Play or Apple App Store are subject to the terms, conditions and refund policies of those platforms.

The Seller does not handle refunds, complaints or subscription cancellations made through Google Play or Apple App Store.

Any claims related to such purchases should be addressed directly to the operator of the relevant platform.

The content offered within Kick&Fit is of an informational and training nature.

The Customer uses the content at their own responsibility, taking into account their health condition and physical capabilities.

The Seller is not liable for the consequences of improper use of the content.

In case of health concerns, the Customer should consult a physician before starting training.

Complaints regarding the operation of the service may be submitted via e-mail to trener@kickandfit.pl.

A complaint should include a description of the issue and data identifying the Customer.

The Seller shall review complaints within 14 days of receipt.

Personal data of Customers are processed in accordance with applicable law and the Privacy Policy.

The administrator of personal data is AZ REKLAMA Arkadiusz Zadłużny.

These Terms and Conditions enter into force on the date of publication on www.kickandfit.pl.

The Seller reserves the right to amend the Terms and Conditions for important legal or organizational reasons.

Matters not regulated herein shall be governed by Polish law.
